外国人来华工作许可所需的学历和无犯罪记录公证认证。

根据国务院行政审批制度改革办公室决定，原“外国人入境就业许可”和原“外国专家来华工作许可”整合为“外国人来华工作许可”。北京上海深圳市已于2016年11月1日起开展外国人来华工作许可制度试点工作。根据国家外国专家局、人力资源社会保障部、外交部、公安部等4部委的有关通知，2017年4月1日起在全国实施外国人来华工作许可制度。 新规的主要改变之处：凡是来华工作超过3个月的，需要提供学位学历和无犯罪记录，同时办理公证认证手续。

近些年随着我国综合国力的发展，很多外籍华人想要申请中国签证。不仅是因为拥有中国签证会给回国出入境以及国内生活等带来便利，更是因为中国繁荣的市场、相同的文化认同感。那么对于中国企业聘用外国人到中国工作居留以及外国人办理永久居留权的时候，有一个非常重要且耗时的必要材料需要准备，那就是无犯罪证明，那么无犯罪证明证明怎么开具，去哪里做？办理海外无犯罪认证需要哪些材料呢？一定要在当地办理吗？

外国人无犯罪证明由本国相关机构出具，可开立各国无犯罪证明，如美国，英国，澳洲，加拿大等国家，外国公民申请无犯罪证明，对于人已经在中国的情况，无需本人回去递交申请。

一、学历学位证书认证途径，以下任一途径认证均有效。

（一）外国学历学位证书认证  

1.中外领事双认证。

申请人国籍所在国外交部门认证→中国驻所在国驻外使(领)馆认证。

2.申请人获得学位(学历)所在国驻华使(领)馆认证。

3.中国学历认证机构认证。

（二）港澳台学位(学历)证书认证 

1.中国学历认证机构认证。

2.所在地区公证机构公证。

（三）中国学历学位证书认证

无须认证，提供学历学位证书原件扫描件。 

二、无犯罪记录及认证途径。

无犯罪记录由申请人国籍所在国或经常居住地(申请人离开国籍国最后连续居住一年以上的 国家和地区)的警察、公安、法院等部门出具，以下任一途径认证均可。 

1.中外领事双认证。

申请人国籍所在国外交部门认证→中国驻所在国使(领)馆认证。

2.申请人国籍所在国驻中国使(领)馆认证。 

3.外交部门(含外国驻华使、领馆)出具的非宣誓性无犯罪记录无须认证。 

Authentication of Academic Degree and No Criminal Record

1.Academic degrees shall be authenticated by one of the following ways:

1.1Authentication of the academic degree conferred upon in a foreign country

1.1.1Double authentication.

Authenticated by the ministry of foreign affairs of the country of the applicant’s nationality→authenticated by the Chinese embassies (consulates) in the said country.

1.1.2Authenticated by the embassies (consulates) of the country where the applicant obtained his/her degree (academic) in China.  

1.1.3Authenticated by China’s academic qualification certification body.

1.2 Authentication of the academic degree conferred upon in Hong Kong, Macau and Taiwan

1.2.1Authenticated by China’s academic qualification certification body.

Study Abroad Service Center of the Ministry of Education

1.2.2 Notarized by a notary public in the said region.

1.3 Authentication of the academic degree conferred upon in Chinese Mainland

Authentication is not required. Provide the scanned copy of the original academic degrees.

2.No criminal record and authentication of no criminal record 

The no criminal record shall be issued by the police bureau, public security department or justice department in the country of the applicant’s nationality or habitual residence (the last country or region where the applicant has lived continuously for more than one year since leaving his/her country of nationality) and it shall be authenticated by one of the following ways:

2.1Double authentication. 

Authenticated by the ministry of foreign affairs of the country of the applicant’s nationality→authenticated by the Chinese embassies (consulates) in the said country.

2.2Authenticated by the embassies (consulates) of the country of the applicant’s nationality in China.

2.3The no criminal record of non-oath nature issued by the foreign embassies or consulates in China shall be directly accepted without authentication.
